Intellectual Property Policy
Last updated:
Every tumbler we make combines two kinds of creative work: our designs, and your personal details or photos. This Intellectual Property Policy explains who owns what on cozytumbler.com, what you may and may not do with our designs, images and text, why we decline some personalization requests, and how to report a concern about trademarks, designs or other rights. Copyright takedown notices under the US Digital Millennium Copyright Act follow the specific steps on our DMCA page. For anything else on this topic, write to support@cozytumbler.com with “IP” in the subject line.
At a glance
- Our content: the Cozy Tumbler name, logo, tumbler mark, designs, illustrations, photos and page text belong to Cozy Tumbler or its licensors.
- Your content: you keep ownership of the photos and words you send us; you give us permission to print them on your order.
- What we will not print: other brands’ logos, licensed characters, sports team marks, celebrity images, and artwork you do not have rights to.
- Reporting: email support@cozytumbler.com; we acknowledge reports within 1 business day.
- Copyright notices: use the DMCA process for the fastest legal handling.
What belongs to Cozy Tumbler
Unless stated otherwise, the following are owned by Cozy Tumbler or used under licence, and are protected by copyright, trademark and other laws:
- the name “Cozy Tumbler”, our wordmark, and our tumbler-and-heart mark;
- the tumbler designs offered on our product pages, including layouts, illustrations, lettering arrangements, frames and patterns;
- product photographs and mock-ups;
- written content such as product descriptions, buying guides, policies, our FAQs and this page;
- the selection, arrangement and look of the site as a whole.
Some elements, such as certain fonts or illustration components, are licensed from their creators. Those licences allow us to print them on products we sell; they do not allow anyone else to reuse them.
Our own original work
Our designs are drawn and arranged for the shapes we sell: the long, slim wrap of a 20 oz skinny tumbler, the shorter curve of a wine tumbler, and the smaller surface of a kids tumbler. A name list that fits around a skinny tumbler, a pet portrait framed so the face sits away from the seam, lettering spaced so it still reads when the tumbler is in someone’s hand: this is the craft we put into each design, and it is why we protect it.
What you may do
- Browse the site and print or save pages for your own personal reference, for example to compare designs before ordering.
- Share links to our product pages on social media, in messages or in a family group chat.
- Post photos of tumblers you bought from us, for example showing the gift you gave Grandma. Tagging or naming us is welcome but not required.
- Quote a short passage of our text in a genuine review or article, with a link back to the page.
What you may not do
- Copy our designs, product photos or descriptions to sell products, including on marketplaces or print-on-demand platforms.
- Use our name, logo or mark in a way that suggests we sponsor, endorse or are connected with you or your products.
- Use the “Cozy Tumbler” name in a domain name, social media handle or paid search advertising in a way that could confuse customers.
- Remove copyright notices or watermarks from our images.
- Use automated tools to copy our catalogue or images in bulk.
If you would like to use our content in another way, for example in a magazine gift guide, ask us first. We are usually happy to help.
Your photos and words: who owns them
When you personalize a tumbler, you keep ownership of everything you provide: your photos, your children’s drawings, your own quotes and messages. By ordering, you give us a limited permission to use that content only to make, check and deliver your order, and to handle any reprint, return or support request about it. We do not sell your content, add it to our design catalogue, or use it in advertising. If we would ever like to show a customer’s tumbler as an example, we ask first, in writing, and you can say no.
The design you choose remains ours even when it carries your text. That simply means we may offer the same design, with other people’s names, to other customers, while your personal details remain yours.
Respecting other people’s rights
We want every tumbler we make to be something you can give without worry. That is why we do not print content that belongs to someone else without permission:
| Request | Can we print it? | Why |
|---|---|---|
| Your own family, wedding or pet photos | Yes | You own them or have permission |
| Your child’s drawing | Yes | Your family owns it |
| Names, dates, initials and your own messages | Yes | Personal information, not protected creative work |
| A professional portrait of your family | Usually, with the photographer’s permission | Photographers often keep the copyright |
| Sports team names and logos, college crests | No | Registered trademarks that need a licence |
| Cartoon, movie or video game characters | No | Copyright and trademark of the studio |
| Another brand’s logo or slogan | No | Trademark of that company |
| Celebrity photos or names used as a design | No | Copyright and personal publicity rights |
| Images downloaded from the internet | Only with clear permission | Most online images are protected by copyright |
| Song lyrics or long poem extracts | Usually not | Protected by copyright |
When a request falls into a “no” category, we email you before printing and suggest an alternative, for example team colours with your own text instead of a team logo, or your dog’s own photo instead of a cartoon dog. If you would rather not change it, we cancel the order with a full refund. These rules are also part of our Terms of Service.
When you love a team, a show or a character
Many customers want a tumbler that shows what they are a fan of: a football team, a favourite show, a theme-park trip. We understand the wish, and we know other sellers print logos and characters freely. We do not, because those images belong to the companies that created them and printing them without a licence can harm both the rights owner and you as the buyer. What we can do is help you say the same thing in an original way:
- Colours instead of logos: a design in your team’s colours with your own name and the number you wear in the backyard.
- Your words instead of a slogan: “Sunday is for football and Grandpa’s chili” says more about your family than a printed logo.
- Your photo instead of a character: your kids in their costumes from the trip, rather than the characters themselves.
Email us before ordering if you would like ideas; we are happy to suggest a design that stays on the right side of the line.
Names and likenesses of other people
Everyday personalization, such as your mother’s name, your partner’s initials or a photo of your grandchildren, is exactly what our tumblers are for. Things are different when a design uses the name or face of a public figure, or of a private person in a way they would object to, such as a joke at someone’s expense or a photo of a stranger. People have rights over the commercial use of their own name and image. We do not print designs that use a real person’s identity to mock, harass or misrepresent them, and we decline requests that use a celebrity’s name or face as the design.
Memorial and tribute designs
Memorial tumblers for a parent, a grandparent or a beloved pet are among the most meaningful things we make. They are personal tributes, not intellectual property questions, and you never need permission to remember someone you love. The only rule that applies is the one for photos: use a picture you took or have permission to use. If an old family photo was taken by a portrait studio, the studio may still hold the copyright; if it is still in business, a short request for permission usually settles it, and if you are unsure, ask us before ordering.
Our trademarks
“Cozy Tumbler” and our tumbler-and-heart mark identify our shop and products. Please do not use them for other products or services, or in any way that could cause confusion. Fair, accurate references are fine, for example “I bought this tumbler from Cozy Tumbler”. We do not license our marks to resellers.
How to report an intellectual property concern
If you believe something on cozytumbler.com, or a product we sell, infringes your trademark, design, copyright or other rights, email support@cozytumbler.com with “IP” in the subject line and include:
- your name, the name of the rights owner if different, and your contact details;
- a description of the right concerned, such as a trademark registration number and country, or a link to your original work;
- the web address of each page or image on our site that you are concerned about;
- a short explanation of why you believe it infringes your rights;
- a statement that the information in your report is accurate and that you are the rights owner or authorised to act for them.
For copyright specifically, a notice that includes the elements on our DMCA page lets us act under that legal process.
What happens next
We acknowledge your report within 1 business day. We review it, and where the concern is clear, we remove or disable the material and pause any pending orders that use it while we look further. If the content came from a customer, we let them know and give them the chance to respond. If we need more information, we ask. We tell you the outcome. Where a report turns out to be about one of our own designs and we made a mistake, we take the design down permanently and review similar designs.
Ideas and feedback
We love hearing design ideas from customers: a new grandparent name, a pet breed we have not drawn yet, a holiday we have missed. If you send us a suggestion, you agree that we may use the general idea without paying you, while any artwork you created yourself remains yours unless we agree otherwise in writing. If you are a professional designer offering work, please say so in your email so we can discuss proper terms instead.
